These Terms of Service ("Terms") govern your access to and use of Kapable's platform, APIs, and related services ("Services"). By using our Services, you agree to these Terms.

1. Account Registration

To use our Services, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials and API keys
Promptly notify us of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

2. Acceptable Use

You agree not to use our Services to:

Violate any applicable laws or regulations
Infringe upon the intellectual property rights of others
Distribute malware or engage in any form of cyberattack
Attempt to gain unauthorized access to our systems or other users' accounts
Use the platform to build applications that facilitate illegal activities
Exceed rate limits or engage in abusive API usage patterns

3. Your Data

You retain ownership of all data you store on the platform ("Your Data"). You grant Kapable a limited license to host, store, and process Your Data solely to provide the Services. We will not access, use, or share Your Data for any other purpose without your explicit consent.

4. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. Our platform is provided on an "as-is" basis during the pre-production phase.

5. API Usage and Rate Limits

Each plan includes specific API call limits, storage quotas, and rate limits as described on our pricing page. Exceeding these limits may result in temporary throttling or suspension of access until the next billing cycle.

6. Billing and Payment

Paid plans are billed monthly or annually as selected. All fees are non-refundable except as required by law. We may change our pricing with 30 days' notice. Free tier accounts that remain inactive for 90 days may be subject to data deletion after notice.

7. Intellectual Property

Kapable retains all rights to the platform, APIs, SDKs, documentation, and related technology. You may use our SDKs and APIs in accordance with their respective licenses. Nothing in these Terms transfers any Kapable intellectual property to you.

8. Termination

Either party may terminate the agreement at any time. Upon termination:

You may export Your Data for 30 days following termination
After 30 days, Your Data will be permanently deleted
We may terminate accounts that violate these Terms immediately

9. Limitation of Liability

To the maximum extent permitted by law, Kapable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.

10. Indemnification

You agree to indemnify and hold Kapable harmless from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Cape Town, Western Cape.
